1. Introduction

Welcome to Monetive ("Platform", "we", "us", or "our"), a digital product monetization platform operated by Kanglei Sannathong Private Limited, registered at Takyel Khongbal, Imphal West, CRPF Camp Langjing, Manipur, India — 795113.

By accessing or using Monetive at monetive.in, you agree to be bound by these Terms and Conditions. Please read them carefully before using our platform.

2. Definitions

"Creator" means any individual or business that registers on Monetive to sell digital products or services.

"Buyer" means any individual who purchases a product or service through a Creator's payment page on Monetive.

"Digital Product" means any eBook, course, template, PDF, video, or other digital content sold through the Platform.

"Payment Page" means the creator's product listing page hosted on Monetive.

"Platform Fee" means the commission charged by Monetive on each successful transaction.

3. Eligibility

You must be at least 18 years of age to register as a Creator on Monetive. By registering, you confirm that all information provided is accurate and truthful.

Monetive is currently available to residents of India only. Payments are processed in Indian Rupees (INR).

4. Creator Responsibilities

As a Creator on Monetive, you agree to:

4.1 Provide accurate and truthful information about your products and services.

4.2 Deliver the purchased product or service to the Buyer promptly after payment is confirmed.

4.3 Not sell illegal, harmful, defamatory, obscene, or fraudulent content.

4.4 Not impersonate any person, brand, or organization.

4.5 Comply with all applicable Indian laws including the Information Technology Act, 2000 and Consumer Protection Act, 2019.

4.6 Handle Buyer data responsibly and in accordance with our Privacy Policy.

4.7 Set fair and accurate pricing for your products.

4.8 By uploading or listing any product, you warrant that you own it or hold all rights necessary to sell and distribute it, that it does not infringe any third party's intellectual property, and that any claim you make about it is truthful and substantiated. You indemnify Monetive against any claim arising from a breach of this warranty.

6. AutoDM Feature

Monetive's AutoDM feature allows you to automatically send Instagram direct messages to users who comment specific keywords on your posts. By using this feature, you agree to the following:

6.1 You are solely responsible for the content of all automated messages sent through Monetive.

6.2 You will not use AutoDM to send spam, misleading content, harassment, or any content that violates Meta's Community Standards or Instagram's Terms of Use.

6.3 Monetive is not liable for any restriction, suspension, or termination of your Instagram account resulting from your use of the AutoDM feature.

6.4 You grant Monetive permission to access your Instagram account, read comments, and send messages solely for the purpose of delivering the AutoDM service you have configured.

6.5 You may revoke this permission at any time by disconnecting your Instagram account from Monetive's dashboard.

7. Prohibited Content

The following content is strictly prohibited on Monetive:

• Adult or sexually explicit material
• Content that promotes violence, hatred, or discrimination
• Pirated, plagiarized, or copyright-infringing material
• Fake certificates, degrees, or credentials
• Financial investment advice without proper SEBI registration
• Multi-level marketing (MLM) schemes
• Any content that violates Indian law

Products making health, weight-loss, medical, income or earnings claims must not guarantee specific results, must not present typical outcomes as guaranteed outcomes, and must carry a visible disclaimer on the payment page stating that results vary by individual. Medical, nutritional and financial advice may only be offered by appropriately qualified or licensed practitioners.

Monetive reserves the right to remove any content and suspend or terminate accounts that violate these guidelines without prior notice.

8. Intellectual Property

All content uploaded by Creators remains the intellectual property of the respective Creator. By uploading content to Monetive, you grant Monetive a non-exclusive license to display and deliver your content to Buyers.

Monetive's own branding, design, code, and content are the intellectual property of Kanglei Sannathong Private Limited and are protected under applicable law.

9. Payments and Settlements

Payments are processed by the configured gateway, including Paytm or Cashfree. Monetive does not store full payment card credentials.

Creator earnings after recorded fees and taxes are paid to the registered bank account subject to cleared gateway settlement and the payout terms below.

Monetive is not liable for any payment delays caused by Cashfree or banking institutions.

9.1 Chargebacks. If a Buyer raises a chargeback with their bank or card issuer, Monetive will notify the Creator and request supporting evidence (proof of delivery, communication records, the product as delivered) within 5 business days. Monetive submits this evidence to the payment processor. The disputed amount is withheld from the Creator's settlement pending the outcome. If the chargeback is upheld, the amount plus any processor-levied fee is deducted from the Creator's balance. If reversed, the amount is released in the next settlement cycle.

10. Nature of the Relationship

Monetive is a technology and payment facilitation platform. When you purchase a product or service listed on a Creator's storefront, you are entering into a contract with that Creator, not with Monetive or Kanglei Sannathong Private Limited. The Creator is solely responsible for the content, quality, delivery and support of what they sell. Monetive processes the payment and delivers the product on the Creator's behalf.

11. Buyer Protection

Buyers agree that all purchases are final unless the Creator has explicitly stated a refund policy on their payment page.

If a product is not delivered, is materially different from what was described, or you were charged in error, raise a claim to care@mail.monetive.in within 7 days of purchase. We acknowledge claims within 24 hours and complete our review within 3-5 business days. Outcomes are: full refund, partial refund, redelivery, or claim declined with a written reason. If you disagree with the outcome, you may escalate to our Grievance Officer, who will respond within 15 days.

12. Limitation of Liability

Monetive is a platform that connects Creators and Buyers. We do not verify the quality, accuracy, or legality of Creator content. Monetive's liability is limited to the platform fee collected on any disputed transaction.

Kanglei Sannathong Private Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

13. Account Termination

Monetive reserves the right to suspend or permanently terminate any Creator or Buyer account that:

• Violates these Terms and Conditions
• Engages in fraudulent activity
• Files chargebacks without valid reason
• Uploads prohibited content

If an account is terminated, any pending settlement is released within 30 days, subject to completion of fraud and chargeback review, and net of any disputed amounts, refunds or fees owed. Creators may close their own account at any time using the Delete Account page; pending settlements are released on the same terms.

14. Changes to Terms

We may update these Terms and Conditions at any time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify registered users of material changes via email.

15. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Imphal, Manipur, India.

17. Community Features

17.1 Community Creation. Creators on Monetive may create Communities — private or public group spaces where members can communicate, share content, and access exclusive resources. By creating a Community, you agree to:

• Be responsible for all content posted within your Community
• Enforce Monetive's community standards and these Terms among your members
• Not use Communities to distribute illegal, harmful, or deceptive content
• Accurately represent your Community's purpose, pricing, and access terms

17.2 Community Membership. By joining a Community on Monetive, you agree to:

• Comply with the Community's rules as set by the Community owner
• Not harass, threaten, or abuse other members
• Not share content that violates Monetive's Acceptable Use Policy
• Accept that Community owners may remove you from their Community at any time for violations of their rules or these Terms

17.3 Community Payments.

• One-time and subscription payments for Communities are subject to Monetive's flat platform fee (Free 10%, Creator 5%, Business 2%, with no GST added) plus payment gateway charges and GST on the gateway fee only.
• Subscription memberships auto-renew until cancelled by the member or terminated by the creator
• Refunds for Community memberships are subject to the creator's refund policy and Monetive's general refund guidelines
• Monetive is not responsible for the quality, accuracy, or value of content provided within any Community

17.4 Moderation and Bans.

• Community owners and moderators have the right to mute, kick, or ban members who violate Community rules
• Banned members forfeit access to the Community without refund unless Monetive determines otherwise
• Monetive reserves the right to remove any Community or member that violates these Terms

17.5 Community Content.

• Messages, files, and media shared in Communities remain the property of the user who posted them
• By posting content in a Community, you grant Monetive a limited license to store and display that content within the platform
• Monetive does not claim ownership of content posted in Communities
• Creators are responsible for ensuring content shared in their Communities does not infringe third-party intellectual property rights

17.6 Direct Messages.

• Direct messages sent through Monetive's Community DM system are private between sender and recipient
• Monetive does not read private messages except when required by law or to investigate reports of abuse, harassment, or Terms violations
• Do not use DMs to send spam, phishing links, or unsolicited commercial messages

17.7 Polls and Interactive Features.

• Poll results are visible to Community members as configured by the Community owner
• Anonymous polls do not reveal individual votes to other members; however, Monetive may access vote data for abuse investigation if required

17.8 Broadcasts.

• Creators may send broadcast messages to all Community members via push notification and email
• Members may unsubscribe from broadcast emails at any time via their profile settings
• Creators may not use the Broadcast feature to send spam, misleading, or harmful content
• Monetive reserves the right to disable the Broadcast feature for creators who misuse it

17.9 Streaks, Badges, and Achievements.

• Streak counts, achievement badges, and other gamification features are for engagement purposes only
• Monetive does not guarantee the accuracy of streak data across all devices and sessions
• Monetive reserves the right to modify or remove gamification features at any time without notice

17.10 Resources Channels.

• Files and links shared in Resources channels are provided by Community creators and members
• Monetive is not responsible for the content, accuracy, or safety of third-party links or files shared in Resources channels
• Do not share files containing malware, illegal content, or content that violates these Terms

18. Push Notifications and Communications

18.1 By enabling push notifications in Monetive Community, you consent to receive notifications for new messages, community activity, and platform updates on your device.

18.2 You may disable push notifications at any time through your device settings or through your Monetive profile settings.

18.3 Monetive will not sell or share your push notification subscription data with third parties.

18.4 Broadcast messages sent by Community creators are the sole responsibility of those creators. Monetive is not liable for the content of creator-initiated broadcasts.

19. Acceptable Use in Communities

The following are strictly prohibited in all Monetive Communities.

19.1 You must not post, share, or transmit:

• Hate speech, discrimination, or content that targets individuals based on race, religion, gender, sexual orientation, nationality, disability, or any other protected characteristic
• Sexually explicit or pornographic content
• Content that glorifies or promotes violence, self-harm, or illegal activities
• Spam, chain messages, or repetitive unsolicited content
• Phishing links, malware, or malicious code
• Content that impersonates another person or entity
• Personal information of other users without consent

19.2 Violations may result in:

• Removal of the offending content
• Temporary or permanent mute or ban from the Community
• Suspension or termination of your Monetive account
• Reporting to relevant law enforcement if required

WhatsApp Business acceptable use

You must follow the WhatsApp Business Messaging Policy and WhatsApp Commerce Policy, as updated by Meta.

• Obtain and record the recipient’s opt-in before business-initiated messaging. Do not buy contact lists, send spam or misrepresent consent.
• Use Meta-approved templates outside the 24-hour customer service window. Template approval is not consent to message a recipient.
• Honour STOP, UNSUBSCRIBE and OPT OUT immediately. Blocked or opted-out contacts must not receive campaigns or bot messages.
• Do not promote prohibited goods, deceive recipients, impersonate others or use messaging for fraud, harassment or unlawful activity.

Meta controls template approval, messaging limits and account restrictions. Monetive may restrict or suspend use that violates these policies.
